Fourth Amendment

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Protection Against Unreasonable Searches and Seizures

The Fourth Amendment protects you from unlawful searches of your home, property, or belongings.

What this means during an ICE encounter:

  • You do not have to open your door unless ICE presents a valid judicial warrant signed by a judge.

  • You can ask ICE to slide the warrant under the door or show it through a window.

  • You have the right to refuse consent to a search of your home, vehicle, or belongings.
